TERMS OF SALE

AS-IS, NO REFUND, NO WARRANTY POLICY

These Terms of Sale apply to every purchase from Gulf Coast Containers LLC ("GCC").
Please read them carefully before placing an order.

1. AS-IS SALE — NO WARRANTIES

ALL CONTAINERS, EQUIPMENT, AND MATERIALS SOLD BY GULF COAST CONTAINERS LLC ARE SOLD "AS IS, WHERE IS, WITH ALL FAULTS." GCC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTY AS TO CONDITION, AGE, APPEARANCE, DURABILITY, OR SUITABILITY FOR ANY USE. USED CONTAINERS HAVE NORMAL WEAR CONSISTENT WITH THEIR GRADE, WHICH MAY INCLUDE DENTS, RUST, SCRATCHES, PATCHES, FADED OR MISMATCHED PAINT, AND PRIOR MARKINGS OR DECALS.

2. Containers Are Sold by Grade, Not by Individual Unit

Containers are sold by size and grade (for example: One-Trip/New, Cargo-Worthy, or Wind & Watertight). Unless your invoice identifies a specific unit by container number, GCC will select and assign a container of the purchased size and grade from available inventory. Photos and videos on our website, listings, or in messages are representative examples of the grade and may not show the exact unit you will receive.

3. No Depot Visits or Container Selection

Containers are stored at third-party depots that are not open to the public. Buyers may not visit depots, enter storage yards, or select, inspect, or reserve individual containers. Buyer pickups (where offered) must be scheduled in advance through GCC and are subject to Section 10(d).

4. Payment, Cancellation, and Refunds

(a) Before dispatch: An order may be cancelled in writing before the container has been assigned and released for delivery or pickup. Cancelled orders are subject to a cancellation fee of $250 or the actual payment processing fees on the order, whichever is greater, plus any carrier charges already incurred, to cover processing, administrative, and scheduling costs. No cancellation fee applies when GCC cancels an order under Section 4(c) or Section 10(c).

(b) After dispatch: Once a container has been released from the depot or a delivery has been scheduled with a carrier, the sale is final. No cancellations, refunds, returns, or exchanges will be issued.

(c) If GCC cannot fulfill: If GCC cannot deliver a container of the purchased size and grade within a reasonable time, GCC will refund the amount paid for the undelivered item. This refund is the buyer's sole remedy.

5. Delivery Acceptance

The buyer or the buyer's representative must be available at delivery. If the container delivered is not the size or grade purchased, the buyer must tell the driver before the container is unloaded and notify GCC in writing the same day. GCC will then, at its option, replace the container or refund the purchase price, less delivery charges. Once the container is unloaded, it is considered accepted, and accepted containers are final under Sections 1 and 4. A signed delivery receipt, or delivery confirmation photos if no one is present, is proof of delivery and acceptance.

6. Delivery Site Requirements

The buyer is responsible for providing a firm, level, accessible site with adequate clearance for the delivery truck and trailer, including overhead clearance from wires and branches and enough room to maneuver. The driver may refuse to unload where conditions are unsafe. GCC is not responsible for damage to driveways, lawns, landscaping, curbs, septic systems, or underground utilities at the buyer-designated placement location. Failed deliveries caused by site conditions, inaccessibility, or the buyer's absence are subject to redelivery, wait-time, or return charges. GCC is not liable for delays caused by weather, depot availability, carrier scheduling, or other causes beyond its control.

7. Payment Disputes

If you have a concern about your order, you agree to contact GCC at (281) 400-5225 and give us a chance to resolve it before filing any dispute with your bank, card issuer, or payment processor. If a dispute is filed, GCC will submit these Terms of Sale, your acceptance of them, your invoice, loading and delivery photos, delivery confirmation, and all communications to the payment processor. Where permitted by law, the buyer is responsible for costs GCC incurs from disputes found to be without merit.

8. Acceptance of Terms

By paying a deposit, paying an invoice, or completing checkout, the buyer confirms they have read and agree to these Terms of Sale.

9. Security Interest, Default, and Repossession

(a) Security interest: Until GCC has received full payment and that payment is final and no longer subject to reversal, chargeback, or dispute, the buyer grants GCC a purchase-money security interest in each container sold, identified by the container number on the invoice or delivery receipt, and in all proceeds. The buyer authorizes GCC to file a UCC financing statement.

(b) Default: The buyer is in default if any payment is not made when due, or if any payment is reversed, charged back, disputed, returned, or refunded to the buyer by a bank, card issuer, or payment processor, including any provisional reversal while a dispute is pending.

(c) No transfer before final payment: Until payment is final, the buyer will not sell, move from the delivery address, modify, attach to a structure or foundation, or grant any lien on the container without GCC's written consent.

(d) Repossession: On default, GCC and its agents may, to the extent permitted by law, enter the property where the container is located during reasonable hours and remove it without further notice or court order, provided this can be done without breach of the peace. The buyer will keep the container reasonably accessible for removal and will not obstruct removal. GCC may also pursue any other remedy available under the Texas Uniform Commercial Code.

(e) Costs: On default, the buyer will pay all of GCC's costs of collection and repossession, including transport, equipment, labor, storage, resale costs, court costs, and reasonable attorney's fees. Any payment GCC received may be applied to these costs and to the balance owed.

(f) Property owner consent: If the delivery site is not owned by the buyer, the buyer confirms that they have the property owner's permission to place the container there and to allow its removal under this Section.

10. Payment Verification and Fraud Prevention

(a) GCC may, before releasing any container, require the buyer to verify their identity and payment. This may include a government-issued photo ID matching the name on the payment method, card authentication by the issuing bank, a phone call with the buyer, or proof of authority to place the container at the delivery address.

(b) GCC may require payment by wire transfer, settled ACH, or verified cashier's check for any order, and may decline card payments above an amount GCC sets.

(c) GCC may hold, delay, or cancel any order it reasonably suspects involves fraud or unauthorized payment. If GCC cancels for this reason before dispatch, any payment will be returned only to the original payment method. Delays caused by verification do not entitle the buyer to cancel or to compensation.

(d) Containers will be released for pickup only to the buyer or to a carrier GCC has approved in advance. The driver must present ID, and the pickup details must match the order.

(e) GCC will report suspected fraudulent purchases to law enforcement and to the payment processor, and will cooperate in any investigation and recovery of the container.
